These Terms of Service ("Terms") govern your use of this website and any purchase you make from Warden ("Warden," "we," "us" or "our"). By using the site or placing an order, you agree to these Terms. Please read Section 15 carefully: it requires most disputes to be resolved through individual arbitration and waives class actions.

1. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. Our products are sold for personal, non-commercial use.

2. Products and descriptions

We work hard to describe our products accurately. Brightness (lumens), runtime, beam angle and water-resistance figures are manufacturer ratings measured under ideal conditions; real-world performance varies with battery level, mode, temperature and use. Colors may look slightly different on your screen. All products are subject to availability, and we may limit quantities or discontinue products at any time.

3. Prices and payment

Prices are listed in US dollars and may change without notice. Applicable sales tax and shipping charges are shown at checkout. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full. Payments are processed by secure third-party payment providers; we do not store your full card number.

4. Orders

Your order is an offer to buy. We may accept or decline it for any lawful reason, including suspected fraud, unauthorized resale or an unavailable product. If we cancel an order after payment, we refund you in full.

5. Shipping, returns and warranty

Shipping is governed by our Shipping & Delivery policy, returns by our Returns & Refunds policy and product coverage by our 1-Year Limited Warranty. These policies form part of these Terms.

6. Safe use

Our products contain rechargeable lithium batteries and high-output LEDs. Follow the included instructions and all safety warnings. Do not shine lights directly into anyone's eyes, do not submerge products beyond their stated rating, do not open, puncture or modify batteries, and keep products away from extreme heat and out of reach of children. Emergency tools such as window breakers and seatbelt cutters are intended for emergencies only. Light-up glasses are not certified industrial safety eyewear unless expressly stated.

7. Reviews and submissions

If you post a review or send us content, you confirm that it is truthful, reflects your own experience and does not infringe anyone's rights, and you grant us a non-exclusive, royalty-free license to display it on our site and marketing. We may decline to publish content that is spam, offensive, off-topic or unlawful. We do not edit reviews to change their meaning.

8. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account.

9. Intellectual property

All content on this site, including text, photography, graphics, the Warden name and logo, belongs to Warden or its licensors and may not be copied or used without our written permission.

10. Prohibited use

You agree not to use the site for any unlawful purpose, to interfere with its security or operation, to scrape or copy its content at scale, or to submit false or misleading information.

11. Third-party services

The site may link to or rely on third-party services such as payment processors and shipping carriers. We are not responsible for their content or practices, which are governed by their own terms.

12. Disclaimer

Except for our 1-Year Limited Warranty and any rights you have that cannot be waived by law, the site and all products are provided "as is" and "as available," and we disclaim all other warranties to the fullest extent permitted by law.

13. Limitation of liability

To the fullest extent permitted by law, Warden will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our products, and our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some states do not allow these limitations, so they may not apply to you.

14. Indemnification

You agree to indemnify and hold Warden harmless from claims arising from your misuse of the site or our products or your violation of these Terms.

15. Dispute resolution and arbitration

Talk to us first. Before filing any claim, you agree to contact us at support@wardenlights.com and give us 30 days to try to resolve the dispute informally.

Binding arbitration. If we cannot resolve it, any dispute arising from these Terms, the site or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration may be conducted by video or phone or, if in person, in the county where you live.

No class actions. You and Warden each agree to bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding, and both parties waive the right to a jury trial.

Opt-out. You may opt out of this arbitration agreement by emailing us within 30 days of your first purchase with your name, order number and a clear statement that you wish to opt out.

16. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, except where the consumer-protection laws of your state of residence apply.

17. Changes to these Terms

We may update these Terms from time to time. The version posted on this page at the time of your order applies to that order.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. These Terms, together with the policies referenced above, are the entire agreement between you and Warden regarding their subject matter.
